Facts Sean Oââ¬â¢Grady free essay sample
Facts Sean Oââ¬â¢Grady, a professional boxer, was managed by his father, Pat. Sean was a contender for the world featherweight title. Pat entered into a contract with Magna Verde Corporation, an LA based business, to co-promote a fight between Sean and the current world featherweight champion. The fight was scheduled to take place in Oklahoma City. To promote the fight, Pat set up a press conference. At the conference, Pat was involved in a confrontation with a sportswriter named Brooks. Issue Pat allegedly struck Brooks in the face. Brooks brought up a suit against Pat Oââ¬â¢Grady and Magna Verde Corporation in an Oklahoma state court. Court records showed that the only contract Magna Verde had with Oklahoma were that a few of its employees had taken several trips to Oklahoma to plan the title fight. The fight was never held. Oklahoma has a long-arm statute. Magna Verde was served by mail and made a special appearance in Oklahoma state court to argue that Oklahoma does not have personal jurisdiction over it. We will write a custom essay sample on Facts Sean Oââ¬â¢Grady or any similar topic specifically for you Do Not WasteYour Time HIRE WRITER Only 13.90 / page The main argument is that does Oklahoma have jurisdiction over Magna Verde Corporation? Analysis A court is required to use long-arm jurisdiction over persons and businesses in another State when a civil wrong is committed within a State; when there is a contract in the State or a contract affects the State and when a business is transacted that allegedly cause injury to another person. ââ¬Å"long arm jurisdiction is a statutory grant of jurisdiction to local courts over foreign (foreign meaning out-of-state) defendants. A states ability to confer jurisdiction is limited by the Constitution. This jurisdiction permits a court to hear a case against a defendant and enter a binding judgment against a defendant residing outside the states jurisdiction. That is, without a long arm statute, a states court may not have personal jurisdiction over a particular defendant. Generally, the authority of a court to exercise long arm jurisdiction must be based upon some action of the defendant which subjects him or her to the jurisdiction of the court. In the United States, some states long arm statutes refer to specific acts, for example torts or contract cases, which a court may entertain. Other states, like California, broadly grant jurisdiction on any basis not inconsistent with the Constitution of this state or the United States. The use of a long arm statute is usually constitutional where the defendant has certain minimum contacts with the forum state and there has been reasonable notice of the action against him or her. Since the 1960s, several states have enacted one of the two types of long arm statutes (a) the first type enumerates fact situations that submit an individual/corporation to the forums jurisdiction (b) the second type extends the forums jurisdiction to the extent of the constitutional limitations. Conclusion of the courts The conclusion was that the court found that Oklahoma does have jurisdiction in the case because the two parties did schedule a fight in Oklahoma even though the fight did not occur, both sides agreed to a contract as well as the incident happened during a promotion. Opinion My opinion is that Oklahoma should have jurisdiction over this case due to the fact that the event occurred in Oklahoma and that Magna Verde agreed to a contract and that they did business together. The incident between the two sides under contract should mean that long arm jurisdiction should be ruled in effect.
Economic Statistics Essay Example For Students
Economic Statistics Essay 1. Traffic Congestion If a city council faces severe problems with traffic congestion, a knowledge will benefit all parties. It is this I will debate in the lines to come. When traffic is a problem in a city, all sorts of means of transportation can be included, but it is mainly cars which seem to be the problem. Therefor raising gasolin prices (by putting an extra tax on them) should instinctively reduce car usage, seeing that costs for the driver would go up. This is though only the case, if demand for gasolin is inelastic (fig. 1). Here a tax on gasoling has moved the supply curve to S2 and the price to P2, which has lead the quantity demanded from Q to Q2. The difference between Q and Q2 is the essential of the diagram, and it is clear that there has only been a very little decrease in quantity demanded. On fig. 2 demand is elastic, and again a tax on gasolin has been introduced, moving the supply curve to S2 and incresing the price to P2, which then has decreased the quantity demanded to Q2. Here the difference on quantity is great. It is now easy to conclude that if demand for gasolin is inelastic, almost the same will be bought, and there will be hardly any decrease in traffic congestion. If demand is elastic, quantity demanded will go down and so will caruse in general leading to a fall in traffic congestion in the city centre. 3. Gondomar and Bayona If maximum growth rate is a desired goal, the proportion a country spends on consumer goods or investment is highly relevant. In the following I will outline the differences between the two countries Bayona and Gondomar. Gondomar has chosen to have a high proportion of its N.I. spend on investment. If this investment goes into factories and businesses, the investment could turn out to benefit Gondomar in a very positive way. N.I. will go up, and therefor the average GDP pr head will go up as well. This leads to better standard of living. Drawbacks which must also be kept in mind is worsening of nature, pollution, and other external social costs the society will have to live under. Bayonas approach is much more passive, in the sense that she does not strive to achieve growth in the same way as Gondomar. The spending on money here is mainly spend on consumption, which means the economy is more focused on import. If relatively is being produced, N. I. will go down and standards of living will go with it. Overall it is clear that a policy which focuses on investment rather than consumption, is more likely to benefit on long terms. 4. National Income Several problems occur when trying to meassure national income. Even if many factors have to be considered before arriving at a result. The first problem which comes to mind, when considering problems, is the fact that the data collected could easily be unexact. For example is there a very large informal sector in many underdevoped countries. This informal sector includes everything from theft to prostetution. All of this activity is very difficult to anthing but an estimate of. The informal sector does not include farmers providing for themselves, but this is also unrecorded, and should not be left out, when calculating N.I. Meassuring bread which is sold, is realtively easy, while services and certain commodities, usually within the public sector, do not have a price. Here productivity will tend more to an estimate, than an excact value, when adding this number up to N.I. Finnally when the N.I. has been added up, there is a final problem. .u3afc7167026bae691bf128ddb48818e9 , .u3afc7167026bae691bf128ddb48818e9 .postImageUrl , .u3afc7167026bae691bf128ddb48818e9 .centered-text-area { min-height: 80px; position: relative; } .u3afc7167026bae691bf128ddb48818e9 , .u3afc7167026bae691bf128ddb48818e9:hover , .u3afc7167026bae691bf128ddb48818e9:visited , .u3afc7167026bae691bf128ddb48818e9:active { border:0!important; } .u3afc7167026bae691bf128ddb48818e9 .clearfix:after { content: ""; display: table; clear: both; } .u3afc7167026bae691bf128ddb48818e9 { display: block; transition: background-color 250ms; webkit-transition: background-color 250ms; width: 100%; opacity: 1; transition: opacity 250ms; webkit-transition: opacity 250ms; background-color: #95A5A6; } .u3afc7167026bae691bf128ddb48818e9:active , .u3afc7167026bae691bf128ddb48818e9:hover { opacity: 1; transition: opacity 250ms; webkit-transition: opacity 250ms; background-color: #2C3E50; } .u3afc7167026bae691bf128ddb48818e9 .centered-text-area { width: 100%; position: relative ; } .u3afc7167026bae691bf128ddb48818e9 .ctaText { border-bottom: 0 solid #fff; color: #2980B9; font-size: 16px; font-weight: bold; margin: 0; padding: 0; text-decoration: underline; } .u3afc7167026bae691bf128ddb48818e9 .postTitle { color: #FFFFFF; font-size: 16px; font-weight: 600; margin: 0; padding: 0; width: 100%; } .u3afc7167026bae691bf128ddb48818e9 .ctaButton { background-color: #7F8C8D!important; color: #2980B9; border: none; border-radius: 3px; box-shadow: none; font-size: 14px; font-weight: bold; line-height: 26px; moz-border-radius: 3px; text-align: center; text-decoration: none; text-shadow: none; width: 80px; min-height: 80px; background: url(https://artscolumbia.org/wp-content/plugins/intelly-related-posts/assets/images/simple-arrow.png)no-repeat; position: absolute; right: 0; top: 0; } .u3afc7167026bae691bf128ddb48818e9:hover .ctaButton { background-color: #34495E!important; } .u3afc7167026bae691bf128ddb48818e9 .centered-text { display: table; height: 80px; padding-left : 18px; top: 0; } .u3afc7167026bae691bf128ddb48818e9 .u3afc7167026bae691bf128ddb48818e9-content { display: table-cell; margin: 0; padding: 0; padding-right: 108px; position: relative; vertical-align: middle; width: 100%; } .u3afc7167026bae691bf128ddb48818e9:after { content: ""; display: block; clear: both; } READ: Puerto Rico Essay N.I. is usually only helpful when used to compare with other countries economy, and therefor the various N.I.s have to be exchanged on paper to a common currency (usually the dollar) for better comparison. Here the value of N. I. will natuurally vary according to the exchange rate, and not the productivity. Concludingly, it should be stated that all of the above vritirias should be met when calculating N.I. if a correct figure is desired. .

The Sound of Thunder Comparison free essay sample
The Sound of Thunder Comparison The world of the future changed by 1. 3 grams! This Essay is about comparing and contrasting the book to the movie. Ray Bradbury was the author of this story. There are many differences in the story and movie from the guns, the future, the past, and even the characters themselves. There are considerable contrasts between the book and the movie, there are two different perspectives with two different main characters. In the book it says nothing about the owner of Time Safari Inc, but in the movie we see a wealthy man named Charles Hatton. Mr. Hatton isnââ¬â¢t the nicest person in the world. All he wants is the money. He does not care how it is done or what it takes. He turned off the Bio filter, the main machine that helps stop from bringing organic material back from the past. In the original story there was not a bio filter. We will write a custom essay sample on The Sound of Thunder Comparison or any similar topic specifically for you Do Not WasteYour Time HIRE WRITER Only 13.90 / page There was nothing stopping the people from bringing anything back. In the book at the ending Travis shoots Eckles. Travis shoots him because of what he did. Eckles in his confusion walked off the path. He ruined the present and future by doing so. The movie however Travis did not shoot Eckles. They did not know that someone had stepped off the path. They only knew something was wrong. They later found out that Eckles was not the one who stepped off the path. In reality no one stepped off the path but Eckles friend Middleton stepped on a butterfly in the movie. In the book they did not try to change anything at all. Travis knew Eckles had done something, and promised him he would shoot him if when they got back he had changed the present. In the movie however they knew what they had done and ended up trying to fix what they had caused. Travis did not say he would shoot Eckles because they didnââ¬â¢t put two and two together. In the end of the movie they finally were able to save the world and shut down Time Safari Inc. Eckles is the main character in the book, up in the movie it is changed around and it is now Travis as the main character. The book shows the readers the view of Eckles. They see how afraid he is and in his confusion stumbles off the path, thus changing the world as they know it. The movie brings the watcher a more complete account of the story through the life of Travis. Its takes the watcher from the hunt before Eckles trip, all the way until everything is back to normal and shut down Time Safari Inc. These are just a few of the differences between the book and the movie. The movie is good and so is the book. The movie has so many differences to make it long and more enjoyable to the reader. The Movie however is a more complete account than the book is. In all both the book and the movie are good representations of science fiction.

Medicine Bundle Speech Essay Example
Medicine Bundle Speech Essay Example Medicine Bundle Speech Essay Medicine Bundle Speech Essay Medicine Bundle Speech Outline l. Introduction: People would say Girls dont play hockey. Girls dont skate. I would say Watch this. This quote was stated by the first women to play full-time professional hockey in a position other than goalie, Halley Wisenheimer. This extremely talented female went against all the odds and came out on top. How awesome is that If you ask me, a fellow female hockey player, Id say its pretty incredible. I have been playing competitive hockey for the past 14 years of my life. Growing up playing a male nominate sport has impacted my life tremendously and in so many ways has helped form me into the person I am today. Fighting the never ending battle to be accepted and respected in a mans sport, developing the thoughts and emotions of a man, and the impact it has made on mine and my fathers relationship over the years are only a few areas in my life that hockey has impacted. II. Transition Statement: Being a female playing a mans sport is not easy, there is a high standard that you must live up to. A. First off men are naturally more competitive. Most men, in any male dominated sport, feel as though they have to prove their dominance to the female players, which in most cases results in some kind of injury. Over time I realized that I needed to learn to overcome the pain and fight back. I couldnt allow them to intimidate me. B. Secondly as a female Vive always had to fight for my spot on the team that I was I playing for. To be respected in the mens hockey world I quickly discovered that I had to strive to not only be the best female, but the best hockey player on the ice. This kind of demanding life style was difficult to adjust to at first and the stress, well it could be pretty overwhelming sometimes, but overall out-come and all the strengths that I have gained through it all has made me not only a stronger a hockey player but also a much stronger individual in general. Ill. Transition Statement: So with that said, we move along to next topic at hand, developing an understanding of a mans thoughts and emotions. Now many of you may be wondering what exactly it is I mean by this statement. Well as all of us already know men and woman have efferent ways of thinking; dealing with emotions, and senses of humor. Growing up playing hockey, I ended up having pretty much all male friends; therefore I didnt really get to experience the typical girl lingo, never really had much drama to deal with, and I missed out on all the hot gossip. A. The way I socially interact with people, and my way of thinking along with my smart remarks, and blunt personality come from my experiences hanging out with the guys, and also a majority of it comes from what we like to call locker room talk. Urban Dictionary defines locker room talk s the crude, vulgar, offensive, and often sexual trade of comments guys pass to each other. Exists solely for the purpose of male comedy and is not meant to be taken seriously. This quote sums it perfectly. You learn real quickly not to take things the guys. Now there was a time when I wasnt exactly thrilled about that, but over the years I have developed an appreciation for it. My friends have expressed to me time and time again that its their favorite part about me and its what makes me the strong, down to earth, free spirited, understanding and laid back female I am today. V. Transition Statement: Now let me take you back to where it all began. I was the first born female to my family in almost 3 generations. My father, who is from the east coast, and he grew up playing hockey, made it very clear to me as a child that he was hoping for a son. I wanted to be a dancer, as most little girls do, but no he insisted I played hockey instead. A. I didnt want to play hockey, I wanted to be a princess in a castle, or a mermaid under the sea, but instead I tossed those dreams to the side and proceeded to play hockey. For the first few years I had so much resentment towards my dad. Wouldnt you? As time progressed and I started to understand and develop a strong feel for the game, my resentment slowing started to subside. B. I could of been a dancer or a cheerleader, but because of my dads decision to put me in hockey Ive become a unique, strong, fear less, individual and have broken through so many barriers that most people never thought a female could do. For that, I am so very thankful and as the years fly by, its been what keeps us close. V. Conclusion: As Halley Wisenheimer so wisely stated, People would say Girls dont play hockey. Girls dont skate. I would say Watch this. She proves that Just because we as females are smaller and less competitive by nature doesnt mean we cant overcome these high boundaries and come out on top. Fighting the never ending battle to be accepted and respected in a mans sport, developing the thoughts and emotions off man, and the impact it has made on mine and my fathers relationship over the years are only a few areas in my life that hockey has impacted but they are defiantly the most important.

9 Ways of Saying Down in Spanish
9 Ways of Saying Down in Spanish Down is one of those simple, everyday words that can be especially challenging to translate to Spanish. One reason is that it can function as five parts of speech: most commonly an adverb, but also as a preposition, verb, noun and adjective. But even within those categories, theres no consistent way of translating the word. In many cases, the best approach to take in translation is to reword the English and then translate that. For example, if you try translating a sentence such as Im down to only one dollar word-for-word, youll find yourself confused at best. Instead, try using the verb quedar, often used to indicate a remaining quantity. The idea is expressed with Me queda sà ³lo un dà ³lar, which literally means Only one dollar remains for me. Down as the Opposite of Up That said, in many contexts - such as when down means the opposite of up and indicates motion or direction - it is possible to use the adverb abajo, either by itself or in combination with other words, or the related verb bajar, which typically means to go down. This includes most cases where down is functioning as an adverb. Some examples: When I look down I feel dizzy. Cuando miro para abajo me mareo. The accident left him paralyzed from the neck down. El accidente lo dejà ³ paralizado desde el cuello para abajo. The Bilbao Market has gone down 22.72 points at midsession. I prefer to sleep face down. Prefiero dormir boca abajo. Down as an Adjective When down functions as a adjective in English, it often has a specialized meaning that depends on the context. Youll usually be best off recasting the English before translating: The wireless network is down today. La red inalmbrica no funciona hoy. (Literally, the wireless network isnt working today.)She knew he was down with the flu because she called him twice. Sabà a que à ©l estaba enfermo de influenza porque ella le llamà ³ dos veces. (Literally, I have an appointment for 2 p.m.)The down payment normally is a percentage of the price of the house. El pago inicial normalmente es un porcentaje del precio de la casa. Down as a Particle Down is a part of many English phrasal verbs - verbs that are made up of a verb followed by down to form a phrase that has a meaning separate from the verb by itself. To translate, these two-word verbs must be learned separately just as any other vocabulary. Here are a few of many possible examples: My mother isnt going to back down so easily. Mi madre no va a recular tan fcil. The bar was shut down for not meeting safety requirements. El bar fue clausurado por no cumplir las medidas de seguridad. He bowed down before the statue. Down as a Noun The down of a bird is typically referred to as el plumà ³n, although a down pillow is referred to as una almohada de plumas. The down of a fruit is known as la pelusa. In football, a down is usually un down. Down as a Verb As a verb, down usually refers to shooting something down from the sky. A good verb to use is derribar. SG Cowen Case Study Example | Topics and Well Written Essays - 1000 words
SG Cowen - Case Study Example Societe Generale was an international bank founded in 1864 in France and after its collaboration with Cowen and Company; it came to be known as SG Cowen from the year 1998. By the year 2000, it had become one of the worldââ¬â¢s largest banks in the world. By December 2000, they had acquired an asset of more than $430 billion. One of their aims was to place their foothold in the United States as an investment bank. At the inception SG Cowen had around 1,500 employees and they had planned to remain as a ââ¬Ëboutique-sized firmââ¬â¢. The hiring process of the company starts in early spring and winter; therefore the candidates are expected to get involved with the company from summer. In spite of not going to business schools they have recruited various candidates as analysts and promote them to a first year associate when they complete their third year in the firm. A few candidates who have completed their internship of business school in SG Cowen get offer of full-time employm ent after their internship; therefore SG Cowen provide an opportunity for them to join in the subsequent summer after completing their course. Evaluation of the Hiring Process Used by the Firm SG Cowen accepts resumes from the students and conducts informal interview in their office before the formal first round of interview. Therefore, the students can get a chance to know about the industry and their various functions. In the meantime, the company can understand the desire, passion and seriousness of the students for the required position. The recruiting director of the company, Mr. Rae has chosen few banking professionals and bestowed the responsibility of captaining a team. The captain of the team is assigned for all those schools in which SG Cowen will go for campus recruitment. Prior to the commencement of the interview process, each captain of the team makes brief formal presentation of the company and then has an informal conversation with the students for a specified period of time. Subsequently, the informational interview is conducted. The students who are really interested for the company and its position make themselves thoroughly prepared for the first round interview. For selection of the candidate, SG Cowen follows two or three schedules which consist of both open and closed ones. In open schedule, the interests of the students are provided priorities and in closed one, the company selects the resumes of the candidates which have been previously submitted. In the first round of the interview session, the interviewers test the ââ¬Ëculture fitââ¬â¢ of the candidates. They also try to find out the desired candidates who can make it during Super Saturday. Few bankers are generous in their judgment of the students while others are tough during their assessment. The details of the candidateââ¬â¢s profile are mentioned in the assessment sheet which may be helpful to the bankers. The six candidates out of twenty four have been shortlisted for the second round. The interview for the second round is conducted on the campus on the same night. Thus, the selected students can be invited for the Super Saturday. Super Saturday starts on Friday afternoon where selected candidates from different schools arrive and convene with the interviewers for cocktails and dinner at a restaurant. The next day, i.e. Saturday morning is again the time for final round interview. The interview session starts at nine consisting of five half-hour sessions for each candidate with short breaks. As a result, Super Saturday is hectic and exhausting for the interviewers and the interviewees as well. The interviewers have to come to a final decision related to the hiring process at the conclusion of this tiring procedure. After examining all

Information Security Proposal Essay Example | Topics and Well Written Essays - 500 words
Information Security Proposal - Essay Example This includes the recovery from network downtime. It also includes the plans and security in place for the A paradigm can have various meanings. It refers to ââ¬Å"your basic beliefsâ⬠and your approach to the world which affects the way you define your research and how you collect and analyse data (Collis & Hussey, 2003, p. 47). The research approaches used in the study comprises a mixture of both the ââ¬Å"phenomenological paradigmâ⬠which is also referred to as a ââ¬Å"qualitativeâ⬠approach, and the ââ¬Å"positivistic paradigmâ⬠also known as the ââ¬Å"quantitativeâ⬠approach (Collis & Hussey, 2003, p. 47). As the research will utilize interviews to collect data, it would be advantageous to use both the qualitative and quantitative approaches. This will be useful when conducting interviews, as the phenomenological paradigm helps the researcher to ââ¬Å"get a feel for the key issuesâ⬠and provides ââ¬Å"confidenceâ⬠in the accuracy and depth of the data collected as the main issues have been covered (Saunders & Lewis & Thornhill, 2000, p. 98). Furthermore, working within the positivistic paradigm will assist in measuring the data and the correlation between the variables, and the quantitative research outcome could be measured against existing theory. Using a mixture of approaches and techniques has advantages, as all methods have pros and cons. This means using a triangulation approach, which as Denzin & Lincoln (2000) explain ââ¬Å"has been generally considered a process of using multiple perceptions to clarify meaning, verifying the repeatability of an observation or interpretationâ⬠(p. 443). Using both methods will help ensure that the research outcome is accurate and this ââ¬Å"will lead to greater confidence being placed in your conclusionsâ⬠(Saunders & Lewis & Thornhill, 2000, p. 99). It also reduces the ââ¬Å"possibility of getting the answer wrongâ⬠(Saunders & Lewis & Thornhill, 2000, p. 100). For the research, data will be collected from two types of sources,
